Emerge Lotus (emergelotus.com) is owned and operated by Baheejah McThay, a sole proprietor trading as Emerge Lotus ("we," "us," "Emerge Lotus"). When you create an account or purchase a membership, you are entering an agreement with us.

By creating an account or continuing to use Emerge Lotus, you agree to these terms. If you don't agree with them, please don't use the app. You confirm you are of legal age to enter this agreement, and if you're using Emerge Lotus on behalf of an organization, that you have authority to bind it.

Emerge Lotus is a non-custodial financial wellness companion — a calculator, calendar, and tracker with a gentle AI mentor. We never hold, move, or have custody of your money. The numbers in the app are your own records.

Emerge Lotus is education, not licensed financial, legal, or tax advice. We are not a bank, broker, lender, or registered advisor. For big decisions, please sit with a fiduciary.

Please give accurate information and keep it current. You're responsible for keeping your login credentials confidential and for activity that happens under your account. Tell us right away if you believe someone else has access.

You agree not to misuse Emerge Lotus. Specifically, you won't:

• Use the app for anything unlawful, fraudulent, or abusive, including spam.
• Infringe anyone's intellectual property or privacy rights.
• Interfere with the security or integrity of the app — no malware, probing, scanning, scraping, credential stuffing, or circumventing technical limits.
• Reverse engineer, resell, sublicense, or redistribute the app or its content.
• Use the app to provide licensed financial advice to others as if it were your own.

The mentor is powered by AI. Its responses may be incomplete or inaccurate, and they are general education — not professional financial, legal, or tax advice. You are responsible for what you type in, for reviewing anything you rely on, and for your own decisions. We may filter, refuse, or moderate content where needed to keep the app safe and lawful.

The information you enter stays yours. You grant us a limited license to host, store, and process it solely to provide the app to you — nothing more. See our Privacy Notice.

We retain ownership of Emerge Lotus — the software, design, written content, branding, and name. Your membership grants a limited, non-exclusive, non-transferable right to use the app for your own personal money-keeping while your account is in good standing.

The Calendar membership is offered monthly or yearly and renews automatically until you cancel. You may cancel at any time; access continues until the end of the period you've already paid for.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Our own refund window is described on our Refund Policy page.

We work to keep Emerge Lotus available and dependable, but we can't guarantee it will be uninterrupted, timely, or error-free. Features may change, improve, or be retired over time. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability and fitness for a particular purpose.

We may suspend or end access if there is:

• A material breach of these terms;
• Non-payment of a membership;
• A security or fraud risk;
• Repeated or serious violations of acceptable use.

Where it's reasonable and safe to do so, we'll tell you first and give you a chance to fix it. You may close your account at any time. After closure, you'll have a reasonable window to export your records before they are deleted.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost savings, lost data, or loss of goodwill. Our total liability for any claim is limited to the membership fees you paid in the twelve months before the claim. Nothing here limits liability for fraud, death, or personal injury where the law does not allow it.

You agree to indemnify us against claims arising from your content, your unlawful use of the app, or your breach of these terms.

These terms are governed by the laws of the State of Illinois, USA, and disputes will be heard in the courts located there. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of the business. Neither of us is responsible for delays caused by events beyond reasonable control. If any provision is unenforceable, the rest remains in effect.
